These Terms and Conditions ("Terms") govern your access to and use of the Big Daddy Gym website and gym management software ("Service"), provided by Big Daddy Gym ("we", "us", "our"). By accessing our website, requesting a demo, or subscribing to Big Daddy Gym, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Big Daddy Gym is gym management software that helps gym owners manage members, memberships, payments, invoices, renewals and related communications, including WhatsApp and email reminders.

2. Account Registration & Responsibilities

• You must provide accurate and complete information when creating an account or requesting a demo.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You are responsible for managing which of your staff (admin or front-desk) have access to your account, and for their use of the Service.
• You must notify us immediately of any unauthorized use of your account.

3. Subscription Plans & Billing

• Big Daddy Gym is offered on subscription plans billed monthly, with discounted effective rates for 3, 6 or 12 month commitments.
• Each plan defines limits such as the number of members, admin seats, staff seats and membership plans available to you.
• You may upgrade your plan at any time as your gym grows; upgraded pricing applies from the billing cycle in which the upgrade takes effect.
• Subscription fees are billed in advance and, unless required by law, are non-refundable for the period already paid.
• We may suspend access to the Service if payment is not received by the applicable due date.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Send spam, unsolicited or misleading WhatsApp/email messages to individuals who are not your gym members through the Service.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Reverse engineer, copy, resell or misuse the software beyond your subscribed plan.

5. Your Data

All member, payment and membership data that you enter into Big Daddy Gym remains your property. We process this data only to provide the Service to you, including sending WhatsApp and email renewal reminders on your behalf, as described in our Privacy Policy. You are responsible for ensuring you have the necessary consent from your members to store their information and send them communications through the Service.

6. Intellectual Property

The Big Daddy Gym website, software, branding and underlying technology are our property and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights to the Service, other than the right to use it under an active subscription.

7. Third-Party Services

The Service relies on third-party providers such as WhatsApp, email delivery services and payment processors to deliver certain features. We are not responsible for outages, delivery delays or failures caused by these third-party services that are outside our reasonable control.

8. Free Demo

Where we offer a free demo of Big Daddy Gym over a call, WhatsApp or email, the demo is provided for evaluation purposes only and does not create any binding subscription until you choose a paid plan.

9. Limitation of Liability

To the maximum extent permitted by law, Big Daddy Gym shall not be liable for any indirect, incidental or consequential damages arising out of or related to your use of the Service, including loss of revenue, data or business, except where such liability cannot be excluded by law.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or fail to make payment for your subscription.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The updated version will always be available on this page with a revised "Last updated" date.

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, and any disputes shall be subject to the jurisdiction of the courts of India.
